Terms of Service

These terms take effect when the PlotAndPetal apps are released. They are posted here in advance so you can read them, and they may change before release. Posted October 5, 2026.
These terms are between you and PlotAndPetal ("we", "us"). The company behind PlotAndPetal is being formed in Florida; this page will carry its legal name once the state has approved it.

These terms cover the PlotAndPetal apps for iPhone and Android and the browser version at plotandpetal.app.
1. Agreeing to these terms
By downloading or using PlotAndPetal you agree to these terms and to our Privacy Policy. If you do not agree, please do not use it.
You must be at least 13 years old to use PlotAndPetal.
2. What PlotAndPetal is
PlotAndPetal is a gardening app: a plant list and garden map, care logs and reminders, weather and frost information on iPhone, and plant reference guides with their sources shown.
- There are no accounts. What you enter is stored on your own device or, in the browser version, in your own browser.
- It is free to use today. Paid plans and a paid photo-identification feature are planned and are not active yet.
- There are no ads today. The free version will later show our own ads, placed by us and labelled as ads, with no advertising network and no tracking. Paid plans will show none.
3. Your content
Your plants, notes, care logs, garden map and photos are yours. They stay on your device, so we do not receive a copy and claim no rights in them. Keeping backups is up to you: use your device's own backup or the app's export.
If you email us feedback, a bug report or a correction, you give us permission to use it to fix or improve PlotAndPetal, without payment and without any duty on our part to use it.
4. Plant, care and safety information is not professional advice
Please read this section. It is the most important one.
- Care information is general information. Care schedules, hardiness zones, frost dates, pruning and feeding guidance and regional advice come from public sources such as state and provincial extension services, or from what you enter. They are not a substitute for advice from a licensed horticulturist, an arborist or your local extension office when a decision matters to you.
- Pet-safety and toxicity information is not veterinary or medical advice and is not a substitute for emergency care. If a pet, a child or anyone else may have eaten or touched a plant and you are worried, contact your vet, a poison control center or emergency services right away. In the United States, Poison Help is 1-800-222-1222. Do not wait on, or rely only on, anything shown in the app.
- Information about eating, preparing and preserving plants is general information from cited public sources. It is not a statement that a particular plant in front of you is safe to eat. Many plants have only one edible part. Some are safe only when prepared a certain way. Some edible plants have poisonous look-alikes. PlotAndPetal never tells you that a wild plant is safe to eat. If you are not certain what a plant is, do not eat it. For canning and preserving, follow the tested procedures of the food-preservation authorities the app links to.
- Identifying a plant from a photo is a suggestion, not a fact. On iPhone, photo identification is done by Apple's own Visual Look Up feature. Any identification can be wrong, including about whether a plant is toxic or edible. Never use an identification as the only basis for a decision where being wrong could hurt a person, a pet or a plant you are about to eat.
- Pest and disease information describes possible causes. It is not an inspection or a diagnosis of your property. Confirm with your local extension office, and always follow the label of any product you use.
- Where our sources disagree, or where we have not been able to check something, the app says so.
5. Other people's information and services
On iPhone the app shows or links to information from outside sources: weather from public weather services, plant photos and reference material from public reference libraries, and Apple's maps and location services. The Privacy Policy says what each kind of service receives, and the app credits its sources.
We do not control these sources, cannot promise they are accurate or available, and are not responsible for errors in information we did not create. Each has its own terms.
Plant trade names shown in the app are trademarks of their owners. PlotAndPetal is not affiliated with or endorsed by them.
6. Paid features, when they launch
Not active in the current version. When they launch:
- Purchases will be made through Apple's App Store or Google Play. We never see or handle your payment details.
- Before you buy, you will see the price, how long the plan lasts, whether and when it renews, and how to cancel.
- Billing and refunds are handled by Apple or Google under their terms. To ask for a refund, use Apple's or Google's refund process.
- Before your first paid photo identification you will see what it sends and will have to agree.
7. Acceptable use
You agree not to:
- use PlotAndPetal for anything illegal, or in a way that could damage it or the services it talks to;
- copy the app's code or its plant reference content into another product;
- pretend to be us, or send us content that is abusive or that you have no right to share.
8. Ownership
The PlotAndPetal name, logo, design, code and the plant reference content we wrote belong to us. Material from the outside sources in section 5 belongs to them and is used under their terms. We give you a personal, non-transferable licence to use PlotAndPetal for your own gardening.
If you downloaded the iPhone app from Apple's App Store, Apple's standard licence agreement for apps (the Licensed Application End User License Agreement) governs your licence to the app. These terms add to it. Where the two conflict about the licence itself, Apple's agreement controls.
9. No warranties
PlotAndPetal is provided "as is" and "as available", without warranties of any kind, to the extent the law where you live allows. We do not promise that it will be uninterrupted or error-free, or that any information in it, including weather, hardiness zones, plant identification, toxicity or edibility information, is complete or accurate. Some places do not allow certain warranties to be excluded, so some of this may not apply to you.
10. Limits on our liability
To the extent the law where you live allows, we are not liable for indirect, incidental or consequential loss arising from your use of PlotAndPetal. Our total liability for any claim relating to PlotAndPetal is limited to the amount you paid us in the twelve months before the claim, or US $50 if you have paid us nothing, whichever is greater.
Nothing in these terms limits liability that the law does not allow to be limited. That includes liability for our own fraud, and liability for bodily injury in places, such as Québec and Mexico, where the law does not allow it to be excluded.
11. Ending
You can stop using PlotAndPetal at any time by deleting it. There is no account to close. Settings > Delete all my data removes everything first if you wish. We may change or discontinue PlotAndPetal or any feature at any time.
12. Changes to these terms
If we change these terms in a way that matters, we will update the effective date and, for a significant change, tell you in the app before it takes effect.
13. Governing law and disputes
These terms are governed by the laws of the State of Florida, and disputes will be heard in the state or federal courts located in Florida. If you are a consumer and the law of the place where you live gives you rights that cannot be given up by contract, including the right to use your own courts or your own consumer-protection law, you keep those rights.
